MySnake Terms of Use

1. Introduction and Acceptance

These Terms of Use ("Terms") govern your access to and use of the MySnake mobile application (the "App") and its related features, content, tools, customer-support channels and services provided by MySnake (collectively, the "Services").

These Terms apply to the App and its related digital services. Purchases of physical products through the MySnake online store are subject to the separate terms and policies displayed on that store.

By downloading, accessing, creating an account for, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

2. About MySnake

MySnake is a digital record-keeping and husbandry-management application intended to help reptile keepers organise information relating to snakes and their care.

Depending on the version of the App and the features available to you, the Services may allow you to:

• create and manage snake profiles;
• record feeding, shedding, waste, bathing, cleaning, water-change and maintenance information;
• record weight, length, temperature, humidity and other measurements;
• store photographs, notes, schedules and veterinary or health-related information concerning an animal;
• receive care reminders and notifications;
• use camera-based or image-based measurement tools;
• import or export records, including through CSV files; and
• access optional paid or premium features.

The Services may change over time, and not every feature will be available in every version, country, device or operating system.

3. Eligibility

You must be at least 16 years old, or the minimum legal age required in your country to create and manage an online account, to use the Services independently.

If you are below the applicable age, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

You are responsible for ensuring that your use of the Services complies with all laws and regulations that apply to you.

4. User Accounts

You may need to create or authenticate an account to use some or all of the Services.

You agree to:

• provide accurate and current account information;
• keep your login credentials, verification codes and sign-in links secure;
• not allow another person to access your account without authorisation;
• notify us promptly if you suspect unauthorised access or misuse; and
• remain responsible for activity carried out through your account, except to the extent caused by our failure to use reasonable security measures.

You must not create an account using another person’s identity or information without their permission.

5. Animal Welfare, Veterinary and Husbandry Disclaimer

MySnake is an organisational and record-keeping tool. It is not a veterinary service and does not provide veterinary, medical, diagnostic, emergency, breeding, legal or professional husbandry advice.

Information displayed by the Services may be based on information entered by you, default settings, schedules, calculations or automated processing. MySnake does not independently inspect your animals, enclosures, records or husbandry practices and does not verify that information entered into the App is accurate, complete or suitable.

You remain solely responsible for:

• the health, welfare, handling and care of your animals;
• feeding schedules and prey selection;
• enclosure security, temperature, humidity, lighting and environmental conditions;
• medication, treatment and veterinary decisions;
• breeding and reproductive decisions;
• compliance with animal-welfare, licensing, ownership and transport laws; and
• seeking qualified professional assistance when needed.

The Services must not be relied upon in an emergency. Contact an appropriately qualified veterinarian or emergency service where urgent advice or treatment is required.

6. Care Reminders and Notifications

Care reminders, due dates and notifications are provided as a convenience only. They are not a substitute for your own care schedule, observations or professional judgement.

Notification delivery may depend on factors outside our reasonable control, including:

• your device and operating system;
• internet or network availability;
• notification permissions and device settings;
• battery-saving, focus or background-processing settings;
• Apple, Google or other notification infrastructure; and
• temporary faults, maintenance or service interruptions.

We do not guarantee that a reminder will be delivered, displayed, received or acted upon at a particular time. You remain responsible for independently monitoring and carrying out all animal-care tasks.

7. Measurement and Camera-Based Tools

Any measurement, image-calibration or camera-based tool provided by the App is intended to produce an estimate only.

Results may be affected by factors including:

• camera angle and perspective;
• image distortion, cropping and resolution;
• lighting and visibility;
• the shape, movement or position of the animal;
• placement of reference and measurement points;
• the accuracy of a reference object or entered value; and
• device hardware and user input.

You must verify any result before relying on it. The measurement tools must not be used where precise, clinical, commercial, legal or safety-critical measurements are required.

8. User Content and Records

"User Content" means information or material that you create, enter, import, upload or store through the Services, including photographs, notes, snake profiles, husbandry records, veterinary information, measurements, schedules and CSV data.

You retain ownership of your User Content. By submitting User Content to the Services, you grant MySnake a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit and display that content only to the extent reasonably necessary to provide, secure, maintain and improve the Services.

You confirm that:

• you own the User Content or have the necessary rights and permissions to use it;
• the User Content does not unlawfully infringe another person’s rights;
• you will not upload malicious, unlawful or harmful material; and
• you will not include unnecessary personal information about another person without a lawful basis or their permission.

We do not claim ownership of your User Content and do not use private husbandry records, snake photographs, veterinary notes or care logs for third-party behavioural advertising.

9. Accuracy of Data, Imports and Exports

You are responsible for reviewing the accuracy, completeness and suitability of all information stored in or generated by the Services.

MySnake does not independently verify:

• feeding, shedding, cleaning or maintenance records;
• weight, length, temperature or humidity values;
• medication, health or veterinary notes;
• dates, schedules or reminder intervals;
• species, morph, sex or identification information; or
• data imported from CSV or another source.

Imported data may be incomplete, duplicated, incorrectly mapped or formatted differently from the original source. You must review imported information before relying on it.

Where export functionality is available, you are responsible for securing exported files, maintaining any backups you require, and controlling where those files are stored or shared.

10. Acceptable Use

You must not:

• use the Services for any unlawful, fraudulent or harmful purpose;
• attempt to gain unauthorised access to an account, system, network or database;
• interfere with, disrupt, damage or overload the Services;
• introduce malware, malicious code or harmful files;
• circumvent security, access controls, account limits or payment restrictions;
• scrape, harvest, extract or access the Services through automated means without our written permission;
• reverse engineer, decompile or disassemble the App except where applicable law expressly permits this;
• copy, modify, distribute, sell, rent or sublicense any part of the Services except as expressly permitted;
• impersonate another person or misrepresent your identity or affiliation;
• use another person’s account without authorisation; or
• use the Services in a manner that infringes the rights of MySnake or another person.

11. Intellectual Property

The Services, including the App software, source code, object code, interface, databases, functionality, designs, text, graphics, icons, logos, branding and other content supplied by MySnake, are owned by MySnake or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, MySnake grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable right to download and use the App on a device that you own or control, solely for your personal and lawful use.

No right, title or interest in the Services is transferred to you except for the limited right of use expressly granted by these Terms.

12. Paid Features, Subscriptions and In-App Purchases

Some features may be offered on a paid, subscription or in-app purchase basis.

Where a purchase is made through the Apple App Store or Google Play:

• the relevant platform processes the payment;
• billing, renewal, cancellation and refund arrangements are governed by that platform’s terms and policies;
• you are responsible for managing or cancelling the subscription through your platform account; and
• deleting the App or your MySnake account may not automatically cancel an active subscription.

Prices, features and subscription plans may change. Any material change to an active subscription will be handled in accordance with applicable law and the requirements of the relevant app-store platform.

Unless required by law or the applicable platform’s rules, MySnake does not directly issue refunds for payments processed by Apple or Google.

13. Third-Party Services

The Services may depend on or integrate with third-party services, including account-authentication providers, cloud hosting, database storage, email delivery, app stores, notification infrastructure and diagnostic services.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for the availability, content, security or operation of a third-party service beyond our reasonable control.

We may change, replace or discontinue a third-party integration where reasonably necessary for technical, security, legal or operational reasons.

14. Availability, Maintenance and Changes

We may update, modify, suspend, restrict or discontinue any part of the Services, including features, storage limits, account limits, compatibility or availability.

We may carry out maintenance, security updates, bug fixes or infrastructure changes without prior notice where reasonably necessary.

Although we aim to provide a reliable service, we do not guarantee that the Services will always be available, uninterrupted, secure or error-free, or that every defect will be corrected.

15. Backups and Data Loss

We use reasonable measures to maintain and protect information stored through the Services, but no system is completely reliable or immune from interruption, corruption, deletion, security incidents or technical failure.

You should maintain your own copy or export of any information that is particularly important to you where export functionality is available.

To the fullest extent permitted by law, MySnake is not responsible for data loss caused by your actions, device failure, unauthorised account access, third-party services, incompatible imports, failure to maintain your own backup, or circumstances outside our reasonable control.

16. Suspension and Termination

You may stop using the Services at any time. Where available, you may initiate account deletion through the App or contact us for assistance.

We may suspend, restrict or terminate your access where reasonably necessary, including where:

• you materially or repeatedly breach these Terms;
• we reasonably suspect fraud, unlawful activity or abuse;
• your use creates a security, operational or legal risk;
• payment for a paid service is reversed, disputed or remains unpaid;
• we are required to do so by law, a court, a regulator or an app-store platform; or
• we discontinue the Services.

Where appropriate and reasonably practicable, we will provide notice before termination and an opportunity to remedy the issue.

Termination does not affect rights, obligations or liabilities that arose before termination. Provisions that by their nature should survive termination will continue to apply.

17. Disclaimers

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not warrant that:

• the Services will meet every individual requirement;
• the Services will be uninterrupted, timely, secure or error-free;
• reminders or notifications will always be delivered;
• measurements, calculations, imported data or displayed records will be accurate;
• data will never be lost, corrupted or unavailable; or
• the Services will be compatible with every device, operating system or third-party service.

Nothing in these Terms limits any mandatory warranty or consumer right that cannot lawfully be excluded.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above and to the fullest extent permitted by applicable law, MySnake will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business, opportunity, goodwill or anticipated savings arising from or connected with the Services.

Without limiting the general wording above, MySnake is not responsible for loss or damage arising from:

• a missed, delayed or incorrect reminder;
• inaccurate, incomplete or incorrectly entered records;
• measurement or calculation errors;
• decisions relating to animal care, feeding, treatment or husbandry;
• injury, illness, escape or death of an animal;
• veterinary fees or other animal-care costs;
• loss, corruption or unauthorised disclosure of data where not caused by our breach of applicable law;
• third-party platforms, services or integrations; or
• your failure to follow these Terms or maintain appropriate independent records and backups.

If applicable law does not permit a particular exclusion or limitation, that exclusion or limitation will apply only to the maximum extent permitted.

19. Indemnity

To the extent permitted by law, you agree to compensate MySnake for reasonable losses, liabilities, claims, damages and costs arising directly from:

• your unlawful or unauthorised use of the Services;
• your material breach of these Terms;
• User Content that unlawfully infringes another person’s rights; or
• fraud, wilful misconduct or malicious activity carried out through your account.

This section does not require a consumer to compensate MySnake for matters caused by MySnake’s own breach, negligence or unlawful conduct.

20. Privacy

Our collection, use, disclosure, retention and protection of personal information are described in the MySnake Privacy Policy.

By using the Services, you acknowledge that you have read the Privacy Policy. The Privacy Policy is available at:

21. Apple App Store Terms

If you downloaded the App through Apple’s App Store, the following terms also apply:

• these Terms are between you and MySnake, not Apple;
• MySnake, not Apple, is solely responsible for the App and its content;
• Apple has no obligation to provide maintenance or support services for the App;
• to the extent any warranty applies and cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with its applicable terms;
• Apple has no other warranty obligation concerning the App to the maximum extent permitted by law;
• MySnake, not Apple, is responsible for addressing claims relating to the App, including product-liability, legal, regulatory and consumer-protection claims;
• MySnake, not Apple, is responsible for investigating, defending, settling and discharging any claim that the App infringes a third party’s intellectual-property rights;
• you represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government restricted-party list;
• you must comply with applicable third-party terms when using the App; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the relevant App Store provisions against you.

22. Google Play Terms

If you downloaded the App through Google Play, your use of the App is also subject to the applicable Google Play terms.

These Terms are between you and MySnake. Google is not responsible for providing support for the App except as required under its own terms or applicable law.

23. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, legal requirements, security needs or other operational reasons.

We will post the revised Terms and update the "Last updated" date. Where required by law, or where a change materially affects your rights, we will provide additional notice.

Your continued use of the Services after revised Terms take effect means that you accept the updated Terms. If you do not agree to a material change, you must stop using the Services.

24. Governing Law and Disputes

These Terms are governed by the laws of Malta.

The courts of Malta will have jurisdiction over disputes arising from or connected with these Terms, except where mandatory consumer-protection law gives you the right to bring proceedings in another court or requires another law to apply.

Nothing in these Terms limits any mandatory rights available to you as a consumer under the law of your country of residence.

25. General Provisions

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our written permission. We may transfer our rights and obligations in connection with a business reorganisation, merger, sale or transfer of the Services, subject to applicable law.

These Terms, together with the Privacy Policy and any additional terms presented for a particular paid feature, form the agreement between you and MySnake concerning the Services.
